This bill, known as the Defend the Guard Act, creates a new section of the Kentucky Revised Statutes (KRS) Chapter 38 to restrict the use of the Kentucky National Guard outside of state active duty unless the U.S. Congress has officially declared war or taken official action pursuant to the U.S. Constitution, and has satisfied any outstanding balance to the Kentucky National Guard. The bill does not limit or prohibit the Governor from consenting to the deployment of the Kentucky National Guard for defense in support of civil authority missions within the United States or its territories.
