AN ACT to amend the tax law, in relation to creating an excise tax on the collection of consumer data by commercial data collectors

AI Summary

This bill creates an excise tax on the collection of consumer data by commercial data collectors in New York State. The key provisions include: 1. Imposing a monthly excise tax on commercial data collectors that collect consumer data (excluding contact information) on more than 1 million individual New York consumers in a month. 2. Defining "commercial data collector" as a for-profit entity that collects, maintains, uses, processes, sells, or shares consumer data in support of its business activities. 3. Establishing tax rates based on the number of New York consumers the commercial data collector collects data on, ranging from 5 cents per consumer over 1 million up to 50 cents per consumer over 10 million. 4. Providing a rebuttable presumption that a consumer with a New York address or IP address is a New York consumer, and requiring business entities with common ownership to be treated as a single taxpayer. 5. Allowing commercial data collectors and the Department of Taxation and Finance to agree on alternative methods for determining the number of New York consumers for tax calculation purposes. The bill will take effect immediately and apply to tax years starting more than 6 months after the law is enacted.
