AN ACT to amend the executive law, in relation to bias-based profiling

AI Summary

This bill prohibits police officers from using bias-based profiling, which is defined as relying on a person's actual or perceived race, color, ethnicity, national origin, immigration or citizenship status, age, religion, gender identity or expression, sexual orientation, mental or physical disability, socioeconomic status, or housing status when selecting who to stop or the scope of law enforcement action. The bill requires law enforcement agencies to establish procedures for reviewing and taking corrective action on complaints of bias-based profiling. It allows the Attorney General to bring civil actions for injunctive relief and/or damages against agencies engaged in a pattern of bias-based profiling, and allows individuals who have been subject to such profiling to bring their own civil actions. The bill also mandates the collection and reporting of data on law enforcement encounters to monitor for bias.
