This bill amends existing Idaho law to revise provisions regarding the careless exposure of barbed wire. The key changes include: 1) making it unlawful for any person, occupant, owner, firm, or corporation to allow barbed wire or barbed wire fences to be left down or in disrepair in a manner that could allow livestock to escape and be injured; 2) requiring any sheriff, deputy, constable, or police officer who knows about such a violation to notify the responsible party; 3) making it unlawful for the responsible party to fail to correct the violation within 10 days of receiving notice; and 4) revising the penalties, making first-time violations an infraction punishable by a $150 fine, second-time violations within 5 years an infraction punishable by up to a $300 fine, and third-time violations within 5 years a misdemeanor.
