This bill, known as the Guidance Out Of Darkness Act (or the GOOD Act), aims to increase access to agency guidance documents. The key provisions are: 1) Agencies must publish all guidance documents (defined broadly as any non-binding policy or interpretive statements) on a single website designated by the Office of Management and Budget (OMB) Director. Agencies must also provide links to this website on their own websites. 2) Agencies must publish previously issued guidance documents within 180 days of the bill's enactment. 3) Guidance documents that are exempt from disclosure under the Freedom of Information Act (FOIA) are not subject to the publication requirements. 4) Agencies must maintain and indicate when guidance documents are rescinded, including if it was due to a court order. 5) The bill clarifies that noncompliance with the Act does not affect the validity of guidance documents, nor does it impact whether they are subject to congressional review. 6) The Government Accountability Office (GAO) must submit a report on agency compliance with the Act within 5 years of its enactment.
