This bill amends the Vehicle and Traffic Law to add a new provision to the offense of first degree aggravated unlicensed operation (AUO) of a motor vehicle. Specifically, the bill states that a person commits first degree AUO if they are operating a motor vehicle while they have in effect five or more suspensions or revocations imposed on at least five separate dates, under various sections of the Vehicle and Traffic Law. The bill also requires the Commissioner of Motor Vehicles to provide written notice to individuals with four license suspensions or revocations that a fifth such suspension or revocation could result in a charge of first degree AUO, which is a class E felony with a potential definite sentence of up to two years.
