This bill adds a new chapter to Idaho's education law to establish privacy and safety standards in public schools. It requires public school restrooms and changing facilities to be designated for use by either male or female students only, and prohibits students from entering facilities designated for the opposite biological sex. The bill provides limited exemptions, such as for single-occupancy or family-designated facilities. It also allows students who encounter a person of the opposite biological sex in a designated facility to bring a civil lawsuit against the school for up to $5,000 per incident, as well as recover damages for harm suffered. The bill preempts any local laws that would allow schools to permit the use of facilities by students of the opposite biological sex.
