This bill amends the insurance law to require insurance carriers and health plans to provide coverage for at least one abuse-deterrent opioid analgesic drug product per opioid analgesic active ingredient. The cost-sharing for brand name and generic abuse-deterrent opioid analgesic drugs covered under the plan cannot exceed the lowest cost-sharing level applied to non-abuse deterrent opioid drugs. Additionally, prior-authorization requirements or other utilization review measures for opioid analgesics cannot require the use of opioid analgesic drug products without abuse-deterrent properties in order to access abuse-deterrent opioid analgesic drug products. The bill aims to improve patient access to FDA-approved abuse-deterrent opioid medications as a mechanism for reducing opioid abuse and diversion.
