This bill adds a new section to existing Idaho law to create the crime of "critical infrastructure trespass." It defines "critical infrastructure facility" broadly to include a wide range of vital facilities and assets, such as chemical plants, communications networks, and transportation systems. The bill makes it a crime to knowingly and willfully enter or remain in a critical infrastructure facility without permission, and imposes penalties of up to 6 months in jail and a $1,000 fine for a first offense, and up to 10 years in prison and a $10,000 fine for a second offense within 5 years. The bill also allows the state Attorney General to prosecute these crimes if the local prosecutor declines to do so. The bill includes exceptions for those who own or legally occupy the land, are engaged in lawful activities, or are participating in public demonstrations protected by the constitution.
