This bill amends the Civil Practice and Remedies Code to change the statutes of limitation and repose for certain claims arising out of residential construction. Specifically, it reduces the limitation period from 10 years to 8 years for claims against architects, engineers, interior designers, or landscape architects related to the design, planning, or inspection of new residences, alterations, repairs, or additions. It also reduces the limitation period from 10 years to 8 years for claims against contractors related to the construction or repair of new residences, alterations, repairs, or additions, unless the contractor provides a written warranty, in which case the limitation period is 5 years. The bill applies to causes of action commencing on or after the effective date, with some exceptions for pre-existing contracts.
