This bill would amend existing California laws to provide for the enforcement of a ban on the sale of flavored tobacco products and tobacco product flavor enhancers in a manner similar to the Stop Tobacco Access to Kids Enforcement (STAKE) Act. Specifically, the bill would make violations of the flavored tobacco ban punishable by civil penalties, with the primary enforcement responsibility resting with the State Department of Public Health. The bill would also require the California Department of Tax and Fee Administration to assess additional civil penalties and suspend or revoke a retailer's license upon certain violations. The bill would not preempt local standards that impose greater restrictions on access to tobacco products.
