This bill, the Gun Theft Felony Act of 2023, classifies the theft of a firearm, including an antique firearm or a replica of an antique firearm, as a felony. For a first conviction, the penalty is up to 5 years in prison or a fine of up to $1,000, or both. For a second or subsequent conviction, the penalty is up to 10 years in prison or a fine of up to $2,500, or both. The sentence for the theft of a firearm must be separate from and consecutive to any other sentence. The bill also retains existing penalties for other types of theft, which vary based on the value of the property stolen. The bill is set to take effect on October 1, 2023.
