This bill limits the authority of peace officers to stop or detain drivers for certain motor vehicle equipment violations, known as "mandatory secondary offenses" and "presumptive secondary offenses." Officers may only stop or cite drivers for these offenses if they have already lawfully stopped the driver for another reason, the vehicle is unoccupied, or the equipment violation creates a "dangerous condition" or immediate threat to human life. The bill also encourages officers to send warning letters to vehicle owners identifying equipment violations and instructing them to correct the issue, rather than issuing a citation, when they lack grounds to stop the vehicle.
