This bill, the Excluded Employee Arbitration Act, would allow an employee organization representing an excluded state employee to request binding arbitration of a grievance if certain conditions are met. It would establish a standing panel of arbitrators, and under certain circumstances, allow the use of arbitrators from the California State Mediation and Conciliation Service. The bill would grant parties the right to have the arbitration proceedings transcribed, require the arbitrator to apply California law, and order the non-prevailing party, other than the excluded employee, to pay the costs of the arbitration. The bill is set to repeal on January 1, 2029.
