This bill amends Georgia's laws on crimes and offenses. It creates a new offense of "drive-by shooting," which occurs when a person discharges a firearm from a motor vehicle or immediately after exiting a vehicle, with the intent to injure another person or damage property. The bill also modifies the existing offense of aggravated assault to include discharging a firearm from a vehicle or after exiting a vehicle towards a person, occupied vehicle, or occupied building. Additionally, the bill adds the new drive-by shooting offense to the definition of "racketeering activity" under Georgia's street gang terrorism and prevention laws. The bill establishes penalties of imprisonment for not less than 5 nor more than 20 years for the drive-by shooting offense.
