This bill would make it a crime to willfully threaten to commit a crime that will result in death or great bodily injury to any person who may be on the grounds of a school or place of worship, with the specific intent that the statement is to be taken as a threat. The threat must be so unequivocal, unconditional, immediate, and specific as to convey a gravity of purpose and an immediate prospect of execution, and it must cause a person or persons reasonably to be in sustained fear for their own safety or the safety of another person. The crime would be punishable by imprisonment in a county jail or state prison, except that a person under 18 years of age would be guilty of a misdemeanor. The bill would also provide that no reimbursement is required for the state-mandated local program it creates.
