This bill would expand the existing law to allow law enforcement civilians, in addition to law enforcement officers, to testify to out-of-court statements of declarants at preliminary hearings. The bill specifies that the law enforcement civilians must have either 5 years of experience or have completed a training course equivalent to the one required for law enforcement officers. The bill also states that any perjured testimony by either a peace officer or a law enforcement civilian is subject to disclosure as impeachment evidence as required under the Supreme Court case Brady v. Maryland.
