This bill revises the circumstances under which a physician is authorized to prescribe or recommend, and a manufacturer is authorized to provide or make available, an investigational drug, biological product or device. It authorizes a manufacturer to provide or make available an individualized investigational treatment to a patient under certain circumstances. The bill requires the reporting of certain information concerning individualized investigational treatments and investigational drugs, biological products and devices to certain governmental entities. It also prohibits an officer, employee or agent of the state from preventing or attempting to prevent a patient from accessing an individualized investigational treatment. The bill provides a penalty for violations and authorizes the imposition of administrative penalties. Lastly, it allows a patient being treated with an individualized investigational treatment or an investigational drug, biological product or device as of June 30, 2027 to continue receiving such treatment after that date, regardless of whether the patient remains eligible.
