This bill imposes several new requirements related to civil litigation in Nevada: Section 2 requires parties to a civil action to promptly produce and make available for inspection any third-party litigation funding agreements they have entered into. A "third-party litigation funding agreement" is defined as an agreement where a person provides money to a party in exchange for a contingent right to receive a share of any potential settlement, judgment, award, or verdict proceeds. Section 3 makes third-party litigation funding companies jointly and severally liable for any reasonable attorney's fees or costs awarded against a party they have funded. It also allows the court to impose costs and fees on a third-party funding company for a nonparty's response to related discovery. Section 4 defines certain requirements and prohibitions for advertisements for legal services concerning prescription drugs or medical devices, and makes violations a deceptive trade practice under Nevada law. This includes requirements to identify the advertisement as paid, the sponsor, and the attorney/law firm providing the services. The remaining sections make conforming changes to incorporate the new provisions into Nevada's existing laws on deceptive trade practices and consumer protection.
