This bill amends the Texas Property Code to require landlords to provide and maintain a functioning air conditioning system or unit in apartment units. The bill states that a landlord's duty to provide and maintain an air conditioning system or unit cannot be waived. It also specifies that if a landlord fails to provide and maintain a functioning air conditioning system or unit, the landlord must provide the tenant with either a portable air conditioning unit or alternative housing accommodations maintained at the required temperature. The changes in this bill apply to residential leases or rental agreements entered into or renewed on or after September 1, 2023.
