METHODS OF EXECUTION -- Amends existing law to provide for execution by firing squad and to provide for certain requirements prior to an execution.

AI Summary

This bill amends existing law to provide for execution by firing squad, in addition to the existing method of lethal injection. The bill requires the director of the Idaho Department of Correction to determine and certify whether lethal injection is available no later than five days after the issuance of a death warrant. If the director certifies that lethal injection is unavailable or fails to file the required certification, the method of execution shall be firing squad. The bill also allows for firing squad as the method of execution if a court determines that lethal injection is unconstitutional. The bill declares an emergency and states that it shall take effect on and after July 1, 2023.
