Bill Summary
PUBLIC PROCUREMENT -- Amends and adds to existing law to provide that procurement decisions shall not be based on environmental, social, and governance standards.
AI Summary
This bill amends and adds to existing law to prohibit the use of environmental, social, and governance (ESG) standards in public procurement decisions. Specifically, the bill:
1) Prohibits public entities from accepting or denying proposals, bids, or qualifications based on ESG standards, which are defined as subjective ethical or sustainability criteria unrelated to the specifications or qualifications of a bidder.
2) Prohibits design-build contracts and competitive sealed bidding for public works projects from being awarded or denied based on ESG standards.
3) Requires the State Board of Education to revoke approval of procurement policies and procedures for state higher education institutions if they permit the consideration of ESG standards, and subjects those institutions to the state's general procurement laws until new approved policies are in place.
The bill declares an emergency and will take effect on July 1, 2023.
