This bill relates to the regulation of accessory dwelling units (ADUs) by political subdivisions in Texas. It prohibits political subdivisions from adopting certain regulations that would restrict the construction, use, or sale of ADUs, such as requiring owner occupancy of the primary dwelling, minimum lot size, setbacks, height limitations, and impact fees. The bill also requires political subdivisions to process ADU permit applications ministerially without discretionary review and approve or deny the application within 60 days. However, the bill does not supersede historic preservation rules, deed restrictions, or homeowners association rules that limit or prohibit ADUs. The bill takes effect immediately if it receives two-thirds of the votes in each legislative chamber; otherwise, it takes effect on September 1, 2023.
