This bill amends various sections of the Health and Safety Code to provide a defense to prosecution for certain offenses involving possession of small amounts of controlled substances, marijuana, dangerous drugs, or abusable volatile chemicals, or possession of drug paraphernalia, if the defendant was seeking assistance for a suspected overdose. The defense is not available if a peace officer was in the process of arresting the defendant or executing a search warrant, or if the defendant was committing another offense, with some exceptions. The bill applies to offenses committed on or after September 1, 2023.
