This bill prohibits the sale or offer for sale of any flavored tobacco, tobacco-related device, electronic delivery device, or nicotine or lobelia delivery product to consumers in Minnesota. It establishes a rebuttable presumption that a product is flavored if the manufacturer, licensee, or out-of-state retailer makes a public statement about the product's taste or smell, or uses text/images on the label or packaging to indicate a taste or smell other than tobacco. The bill imposes administrative penalties on licensees who violate the prohibition and allows for the confiscation and forfeiture of any flavored products sold or offered for sale. The provisions take effect on August 1, 2023.
