This bill makes several revisions to the expungement process in Utah: 1. It modifies the definition of a "clean slate eligible case" to include certain misdemeanor and infraction convictions, and specifies the waiting periods required before a case is eligible for automatic expungement. 2. It revises the requirements for obtaining a certificate of eligibility to expunge records of an arrest, investigation, or detention, including allowing expungement of certain traffic offenses without a certificate. 3. It changes the requirements for obtaining a certificate of eligibility to expunge records of a conviction, including adjusting the waiting periods and expanding the types of offenses that are ineligible. 4. It adds new procedures for agencies to provide written confirmation of an expungement to the individual, and clarifies when and how expunged records can be accessed or shared between certain government entities. 5. It allows a court to expunge a civil protective order or stalking injunction in certain circumstances, even without a hearing if there is no objection.
