This bill amends the Toxic Substances Control Act (TSCA) to establish a new process for reviewing chemical substances that are considered "critical energy resources." The key provisions are: 1. The Environmental Protection Agency (EPA) Administrator must consider economic, societal, and environmental costs and benefits when determining whether to approve or deny the use of a critical energy resource, even if those factors are not normally considered under TSCA. 2. If the EPA Administrator fails to make a determination on a notice for a critical energy resource within the applicable review period, the submitter can proceed with the proposed actions without the Administrator's approval. 3. The EPA Administrator cannot suggest or request that a submitter withdraw a notice or request a suspension of the review period for a critical energy resource, unless the Administrator has conducted a preliminary review and provided the submitter with a draft determination and supporting information. 4. The term "critical energy resource" is defined as an energy resource that is essential to the U.S. energy sector and energy systems, and has a vulnerable supply chain, as determined by the Secretary of Energy.
