This bill clarifies the scope of affordable housing obligations in New Jersey. It amends the existing law to define "present need" as an estimate of the number of deficient housing units occupied by low and moderate income households within each municipality. It also defines the "gap period" as the time between the expiration of a housing obligation and the start of the next 10-year prospective need period. The bill specifies that municipal fair share calculations should not include retrospective calculations of low and moderate income households created during gap periods. Additionally, it changes the limit on the number of affordable housing units a municipality may be required to address from 10 years to 10 years, unless certain conditions are met.
