This bill amends the Texas Labor Code to add a new Subchapter H that restricts when employers can inquire about and consider an applicant's criminal history record information. Specifically, the bill prohibits employers from including a question about criminal history on the initial employment application, and allows employers to inquire about and consider an applicant's criminal history only after determining the applicant is otherwise qualified and has been conditionally offered the job or invited to an interview. This does not apply to positions where consideration of criminal history is required by law.
