This bill establishes a review process for denials of eligibility for long-term services and supports (LTSS) in Minnesota. It requires lead agencies to provide at least 10 calendar days' notice before issuing a written notice of action to deny, reduce, suspend, or terminate a person's access to or eligibility for certain LTSS, such as home and community-based waivers, personal care assistance, and case management services. The bill also gives the person or their legal representative the opportunity to respond and request a decision review, during which the lead agency must provide a thorough explanation of the proposed decision and allow the person to provide clarifying or additional information. During the review process, the person must continue to receive covered services, and the lead agency must consider the information provided before issuing a final written notice of action. The bill does not affect the person's existing appeal rights under state law.
