This bill amends the Penal Code to provide additional defenses to prosecution for certain criminal offenses involving material or conduct that may be obscene or is otherwise harmful to children. Specifically, it adds a defense for judicial or law enforcement officers acting in the course of their official duties, and modifies the affirmative defense for acts done for a bona fide purpose to include judicial or law enforcement, rather than educational, medical, psychological, psychiatric, or legislative purposes. The changes in the law apply only to offenses committed on or after the effective date of September 1, 2023.
