Bill Summary
AN ACT TO AMEND WHAT CONSTITUTES THE CRIME OF SECOND DEGREE TRESPASS TO INCLUDE ENTERING OR REMAINING ON THE CURTILAGE OF A DWELLING BETWEEN THE HOURS OF MIDNIGHT AND 6:00 A.M.
AI Summary
This bill amends the North Carolina law on second-degree trespass to include entering or remaining on the curtilage (the land immediately surrounding a dwelling) of a dwelling between midnight and 6 AM as a criminal offense. The existing law already prohibited unauthorized entry or remaining on premises after being notified not to do so, or on posted premises. The new provision creates a more severe Class 2 misdemeanor penalty for trespassing on the curtilage of a dwelling during those overnight hours, compared to the Class 3 misdemeanor for the other forms of second-degree trespass. The bill takes effect on December 1, 2023 and applies to offenses committed on or after that date.
