This bill relates to access to and the security of certain critical infrastructure, particularly the electric grid. It amends the Business & Commerce Code to define "affiliate" in the context of agreements involving electric grid equipment. It also allows a business entity to enter into such agreements if it takes reasonable actions to mitigate remote access or control. Additionally, it grants an independent organization certified under the Utilities Code the authority to obtain criminal history record information related to employees and prospective employees who have or seek access to the organization's systems affecting electric grid security. The bill also imposes requirements on independent organizations and business entities related to mitigating access to or control of critical electric grid equipment by certain foreign-owned companies or countries. Finally, the bill specifies that the changes apply only to contracts or agreements entered into on or after the effective date of the act.
