This bill would amend the foreclosure statute in Massachusetts to require judicial foreclosure for residential mortgages on 1-6 family owner-occupied properties. Under the proposed law, all foreclosures would need to be initiated by the filing of a foreclosure complaint in the Superior Court. The court would have the authority to rescind or modify the mortgage, recognize the voidness of any previous acts, and grant other appropriate relief to the mortgagor, while also protecting the rights of any tenants or legal occupants residing in the property. The court would also be required to record any decision recognizing the voidness of previous acts in the appropriate registry of deeds at no cost to the court.
