This bill requires the Massachusetts Department of Public Health to promulgate regulations defining the term "resident representative" in accordance with federal law. This resident representative can be an individual chosen by the resident, someone authorized by state or federal law, a legal representative under the Older Americans Act, or a court-appointed guardian or conservator for residents adjudicated to lack capacity. The bill requires long-term care facilities to notify residents of their right to choose a representative, who can accompany the resident to care plan meetings and support the resident in decision-making related to their care. The bill also specifies that the resident representative's authority is limited to what is authorized by the resident, federal law, or a court of competent jurisdiction.
