This bill creates a new criminal offense in Texas called "Improper Entry from Foreign Nation." The offense applies to non-U.S. citizens or nationals who enter or attempt to enter Texas from a foreign country at an unauthorized location, evade immigration officers, or use false or misleading representations to gain entry. The offense is a Class A misdemeanor, but can be elevated to a state jail felony, second-degree felony, or first-degree felony depending on the person's prior convictions. The bill takes effect on July 1, 2023, if it receives a two-thirds vote in both houses of the Texas legislature, or September 1, 2023, if it does not receive the necessary votes.
