This bill amends the New York Penal Law to update the crime of "aggravated assault upon a police officer or a peace officer." The key changes are: (1) removing the requirement that the assault be committed "by means of a deadly weapon or dangerous instrument," and (2) clarifying that the intent can be to cause serious physical injury to the officer, regardless of whether the officer is male or female ("he or she"). The effect of these changes is to broaden the circumstances under which the more serious felony charge of "aggravated assault" can be applied when an individual assaults a police officer or peace officer in the course of their official duties.
