This bill aims to criminalize sexual assault by fraud committed by medical professionals. It creates two new sections in Chapter 265 of the Massachusetts General Laws: Section 13H½, which makes it a crime for a medical or health care professional to commit indecent assault and battery on a patient or client by using a false representation that the act was for a bona fide medical purpose; and Section 22D, which makes it a crime for a medical or health care professional to knowingly induce a patient or client to engage in sexual intercourse by using a false representation that the act was for a bona fide medical purpose. The bill also amends Chapter 277 of the General Laws to include these new sections in the statute of limitations for criminal actions.
