This bill amends existing law to allow defendants who are pregnant, the primary caretaker of a dependent child, or the primary caretaker of an aging or sick immediate family member to file a motion for pretrial diversion. This would suspend criminal proceedings for a period of 3 to 24 months, during which the defendant can participate in programs, services, restorative justice activities, employment, and/or community service. If the defendant performs satisfactorily during the diversion period, the court will dismiss the underlying case. The bill also establishes a presumption that a primary caretaker's diversion plan is feasible and beneficial, unless the prosecution can show a clear public safety concern.
