This bill aims to restore integrity in the marketing of pharmaceutical products and medical devices. It does this by: 1) Prohibiting pharmaceutical or medical device manufacturer agents from offering or giving gifts of any value to healthcare practitioners, their families, employees, or affiliated organizations. This does not include the provision of peer-reviewed academic, scientific, or clinical information. 2) Requiring pharmaceutical and medical device manufacturing companies to annually disclose to the Department of Public Health the value, nature, purpose, and recipient of any fee, payment, subsidy, or other economic benefit provided to healthcare practitioners, facilities, education programs, or others authorized to prescribe, dispense, or purchase prescription drugs or medical devices. This includes disclosures for board memberships, research, and consulting services. 3) Requiring the licensing and training of all pharmaceutical and medical device manufacturer agents by the Department of Public Health, with a fee to fund the administration and enforcement of the law. 4) Authorizing the Attorney General, district attorneys, and the Department of Public Health to enforce the law, with penalties of at least $10,000 per violation. The overall aim is to increase transparency and limit potential conflicts of interest in the marketing of pharmaceutical and medical products.
