This bill amends Chapter 209C of the General Laws to prohibit courts from issuing temporary or permanent custody orders that award sole custody, shared legal custody, or shared physical custody to a parent against whom an active restraining order has been issued under Chapter 209A or Chapter 258E, unless the parent who filed the complaint consents to the custody award. The bill also prohibits courts from issuing permanent custody orders during the pendency of a restraining order complaint or if a temporary restraining order has been issued without notice, until the defendant has had an opportunity to be heard. If a restraining order is issued after a custody order has been made, the court must revisit and modify the custody order as necessary to comply with these requirements.
