This bill amends Chapter 94C of the General Laws to decriminalize the possession of controlled substances. Under the new law, individuals found in possession of controlled substances would be subject to a civil fine of up to $50 or required to participate in a needs screening to identify and refer them to appropriate health, employment, housing, legal, and other services. The screening would be conducted using evidence-based, culturally and gender-competent, trauma-informed practices, and completion of the screening would result in the fine being waived and the citation being dismissed, with no legal findings made. The bill aims to take a harm reduction and racial justice approach to addressing substance use and related issues.
