This bill proposes to amend the existing law in Massachusetts to define "mental illness" and establish a process for a court to find a defendant "guilty but with a mental illness" in certain felony cases. If a defendant is found "guilty but with a mental illness," the court would impose the same sentence as for a regular guilty finding, but the defendant would serve their imprisonment at a designated facility or, in certain cases, at Bridgewater State Hospital. The bill also allows the court to order a psychiatric or psychological examination for an alleged delinquent to aid the court in its disposition.
