This bill aims to strengthen health spending accountability processes within the Health Policy Commission (HPC) and the Center for Health Information and Analysis (CHIA). The key provisions are: 1. The HPC can now require health care entities identified by CHIA as contributing excessively to health care spending growth to file a performance improvement plan. The HPC can waive or delay this requirement based on certain factors, such as the entity's spending and utilization trends, ongoing strategies to improve efficiency, and overall financial condition. 2. If a health care entity fails to file a performance improvement plan or implement it in good faith, the HPC can impose civil penalties up to the amount of the entity's spending that exceeds the health care cost growth benchmark. 3. CHIA is required to identify and provide a list to the HPC of entities whose contribution to health care spending growth is considered excessive or who fail to submit data in a proper, timely, or complete manner. The HPC can then pursue further action against these entities. 4. The HPC can conduct a cost and market impact review of any provider or provider organization identified by CHIA if the percentage change in total health care expenditures exceeded the health care cost growth benchmark in the previous year.
