This bill amends existing laws related to the lease of property used by non-profit yacht clubs and other non-profit organizations operating boating programs. The key provisions include: (1) requiring the survey of leased property to include navigable channels and berthing/mooring areas, and to establish a schedule for maintenance of navigable waters; (2) mandating the Commissioner of capital asset management and maintenance and the Commissioner of Conservation and Recreation to manage, operate, improve, repair, and maintain the land under water for the term of the lease to ensure recreational boating waterside access and the protection of navigable waterways and channels; and (3) providing that the lessee's lease fees shall be based on adequate access to navigable waters for recreational boating and mooring, and to ensure the capacity for water-dependent uses.
