This bill seeks to clarify the Massachusetts franchise law regarding business practices between motor vehicle manufacturers, distributors, and dealers. Specifically, it exempts manufacturers or distributors from the prohibition on owning or operating a dealership if no franchise agreement existed with any other dealer in the state at the time the manufacturer or distributor-owned dealership was established. Additionally, the bill amends the law to specify that a dealer who suffers a loss due to an unfair method of competition or unfair/deceptive practice must demonstrate that the harmful action was taken with respect to the same line make of vehicles as the dealer's business.
