This bill amends Section 178A of Chapter 149 of the General Laws to establish a process for the payment of a deceased employee's wages to their surviving spouse, children, parents, siblings, or another person who paid the funeral expenses, without requiring letters testamentary or of administration. The bill specifies that the employer may make such payments upon receiving a proper demand, which includes an affidavit and supporting documentation, and that the payment will constitute a full discharge of the employer's obligations and hold the employer harmless from liability. The bill also requires the employer to retain the demand, supporting documentation, and proof of payment as part of the employee's personnel record.
