This bill aims to address emergency response and preparedness in the event of surges in pediatric or adult hospitalizations. The key provisions are as follows: If hospital inpatient staffed-bed capacity rates meet or exceed 85% for any type of hospital bed for 72 hours or more in a given Health and Medical Coordinating Coalition (HMCC) Region, or if the Department of Public Health (DPH) activates its Capacity Planning and Response Guidance for Acute Care Hospitals, the Division of Insurance, in collaboration with the DPH, shall direct all health insurance carriers to waive any prior authorization requirements that impact the transportation or discharge of patients from the hospitals in the affected region for at least 30 days or for the duration of the DPH's activation of the guidance, whichever is longer. The Division, in consultation with the DPH, shall publish guidance implementing these provisions within 30 days of the bill's passage.
