This bill amends Chapter 175 of the General Laws to require homeowners insurance policies to provide coverage for the remediation of home heating oil releases. Specifically, it mandates first-party property coverage for response action costs and property damage, as well as third-party liability coverage for claims arising from the release of heating oil. The minimum coverage is $75,000 per occurrence for first-party property and $250,000 per occurrence for third-party liability, subject to a $1,000 deductible. Insurers may exclude coverage if the release was caused by the owner's failure to comply with relevant regulations, but they must provide annual written notice explaining those requirements. The bill applies to policies issued or renewed on or after January 1, 2024.
