This bill amends the fourth paragraph of Section 34M of Chapter 90 of the General Laws in Massachusetts. It states that if an insurance company makes payment of the amount owed on a personal injury protection benefit claim after a legal action has been initiated but before a judgment is reached, the court may still assess costs and reasonable attorney's fees for the action, but only up until the time of payment. Additionally, interest will be assessed on all amounts adjudged to be due and payable in such an action, at the same rate as interest for breach of contract actions in the Commonwealth.
